These Terms of Service ("Terms") govern your use of the services provided by Spark Socials ("we", "us", or "our") in relation to our event services. By using our services, you agree to these Terms. 

Spark Socials offers social event services where individuals can submit their dating preferences and desired activities. We use a combination of manual and data analysis methods to group individuals into compatible groups, based on their preferences. Participants will then be invited to attend events tailored to their preferences. Participants will have a timeline to accept and purchase a token for the selected and curated event. 

Our services are exclusively available to individuals who are 18 years old and above. By using our services, you represent and warrant that you meet this eligibility requirement.

Upon acceptance of an invitation to participate in an event, participants are required to pay the applicable fees in advance, including administrative and activity fees. These fees are non-refundable, except as otherwise provided by law or as stated in our cancellation policy.

Participants are required to comply with the code of conduct established by Spark Socials for event participants (click here). This code of conduct outlines expected behavior and standards of interaction during our events. Failure to comply with the code of conduct may result in the immediate participant's removal from the event and may affect their eligibility to participate in future events.

In the event of cancellation by the participant:

1. If cancellation occurs more than three weeks (21 days) before the scheduled event date, the participant is entitled to a full refund of the amount paid.
2. If cancellation occurs between three weeks (21 days) and two weeks (14 days) before the event, the participant will receive a refund equal to 75% of the amount paid.
3. Cancellations made less than two weeks (14 days) before the event are not eligible for a refund.

All cancellation requests must be submitted in writing to so.when.we.meet@gmail.com including the participant's name and event details.

Exceptions to this cancellation policy may be granted by Spark Socials in exceptional circumstances/unforeseeable circumstances that will prevent the participant from joining the event. This is however subject to review on a case-by-case basis and does not automatically grant the participant a right to a refund or credit refund. 

We may collect personal data provided by participants, including dating preferences and feedback. With participants' consent, we may share their contact information with other participants for networking purposes. We adhere to strict data protection regulations, including the General Data Protection Regulation (GDPR), in the collection, storage, and sharing of personal data.

By attending our event, the participant acknowledges that photographs and filming may take place. Spark Socials reserves the right to use images and videos recorded at the event with the participant's image and/or likeness in future marketing materials, including social media channels, websites, and print material, without obtaining any further approval from you or making any payment to you.

If a participant wishes to object to the use of their image in such materials, they may submit a written request to Spark Socials via email at so.when.we.meet@gmail.com. Spark Socials will make reasonable efforts to accommodate such requests, although it may not be possible to remove the participant's image from materials that have already been distributed or published.

Participants understand that their attendance at Spark Socials events constitutes acceptance of this clause.

Participants may be asked to provide feedback following events. By submitting feedback, participants consent to the use of their feedback and testimonials for promotional purposes, including on our website and marketing materials and to improve our services.

To the extent permitted by law, Spark Socials shall not be liable for:

(1) any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our services

(2) loss of profits, loss of data, or loss of goodwill. 

For the avoidance of doubt, Spark Socials will not be liable to you in respect of any losses arising out of events beyond our reasonable control, and in the event a participant causes any damages to the property of another individual, they will be solely liable.  

All content provided through our services, including but not limited to text, graphics, logos, images, and software, is the intellectual property of Spark Socials and is protected by copyright and other intellectual property laws. You may not reproduce, distribute, modify, or otherwise use any of our content without our prior written consent.

These Terms shall be governed by and construed in accordance with the laws of the Netherlands. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of the Netherlands.

We reserve the right to update or modify these Terms at any time without prior notice. Any changes will be effective immediately upon posting on our website. Your continued use of our services after the posting of amended Terms constitutes your acceptance of the 

changes. In the event that any provision of these Terms is found to be invalid, unlawful, or unenforceable by a court of competent jurisdiction, such provision shall be deemed severable from the remainder of these Terms, which shall remain valid and enforceable to the fullest extent permitted by law.
